Acceptance of sale conditions
The present general sale conditions govern relations between LME and his customer ( a consumer, physical person and particular, a gallery) in the frame of a sale system at distance, the two parties accepting them without reserve. The present conditions are available on site at the main adress mentioned above, and will prevail on all other conditions.
The client declares having taken knowledge of the following measures before taking command of the products. By choosing to buy the products of LME ARDINO'S ART GALLERY, the client accepts expressly and irrevocably the terms therafter announced.
Characteristic of sold goods
The technical cards presenting the products on the site do not enter into the contractual field. They are only a presentation of the product effectively sold. If mistakes occur under no circumstance are the company LME Ardino's Art Gallery liable or responsible for these errors. Only the sold product enters the contractual field.
Acceptance of an order
The client controls that ordered products and seizured adresses are correct and that he accepts in its integrality the general conditions of sale.
The client will recieve a certificate of authenticity 10 days after the reception of delivary, signed by the artist Fabienne Ardino and drawn up on demand by the buyer, from the moment the client does'nt retract his order. The society LME will engage in total confidentally with respect to personal details and adress of his clients.
Confirmation of a order
The order is considered closed and definate after the reception of electronic mail confirming the definitive registration. This confirmation is worth date of conclusion of sale contract.
The commands made on the site and registered in our accounting, will be sent after integral payment has effectively been credited on the account of our company LME.
Cancellation of a command
The company LME gives itself the right to cancel any customer command with whom would exist a conflict linked to the payment of a previous command. The fault of information has as a consequence the non validation of the command.
Prices
The prices are firm and definit. Only the money euro is accepted.

Payment and transaction security
The payment of products is effective in totality at command, by bank transfer, swift transfer on our account at the following address :

The transfer bank costs are wholly at the charge of the client.
Transport (for on line sale)
The products leave our warehouses and are delivered at the address given while registering on line in. No way can a delivery delay lead to an indemnity or bring a partial or total cancellation of the command
The delivery delay can vary according to destination, by principle you can count a delay of 15 open days from departure from the atelier. The commands are delivred by FEDEX, UPS, la Post, Chronopst, TNT ...
For countries not of the CEE, the eventual custom taxes are at the charge of the client.

For paintings more than 40 Kg a supplement will be demanded. The client will be averted of this before refund with reduced.
Retractation delay
The buyer has 7 days from reception of the articles to exchange it. In case of exchange, the buyer takes care of expenses of sending back new articles in their origin packing, cardboard in good state at the following address :

In the case of retractation, LME will refund the sums paid by the client for the merchandise, with transport costs deducted ; after reception of merchandise and with a delay of not more than 15 days, and with no added supplements, and on condition that the merchandise is not damaged. Ownership reserve clause
By express convention, all products remain our ownership wherever they are until full payment of due bills. This does not prevent, at merchandises delivering, risks transfer of the buyer's goods.
Image protection
Piratage of any of the artist's paintings will not be tolerated, and willbe immediately pursued by the justice. The artiste Fabienne Ardino reserved the right at any time to use the supports of hor choice, photos of her work, already solfd, to promote her work, i.e pressbook, magazines, internet etc ...
Responsability of the LME ARDINO'S ART GALLERY
In no case LME be responsable for delays of any kinds like :
Strikes of any kind, political risks, thefts of merchandises, piracy, wars, inundations, maritime, earthly, air collisions, fires, terrorist acts.
In case of raise of transport or oil costs, LME gets the right to add supplementary costs at your charge after adverting you by mail.
Applicable law, lawsuit settlement and competent jurisdiction
The present general conditions of sale are submissive to application of french law, with the exception of Vienna convention.
As far as sale to private individuals are concerned, the courts of the registered office LME, located in NICE FRANCE will be the only competent for any suits coming from application of the present.
